H.R. 8 – Bipartisan Background Checks Act of 2019 (Rep. Thompson (CA) – Judiciary)

    • Federal law already requires licensed gun dealers to conduct background checks on gun purchasers and transferees.  H.R. 8 extends the requirement of background checks to unlicensed gun sellers. Under H.R. 8, unlicensed gun sellers would meet their buyers at a licensed gun dealer, who would run a background check using the same process already used for sales from their own inventory.
    • 80 percent of firearms used for criminal purposes are obtained without a background check – through an unlicensed gun seller like a gun show, online, or person-to-person.
    • The bill requires a background check for every gun sale or transfer, with reasonable and explicit exceptions such as giving a gun as a gift to a close family member; loaning a gun for hunting or target shooting; or providing a gun in the moment of self-defense.

The Rule provides for one hour of debate and makes in order the following amendments:

Lesko Amendment (10 minutes of debate)

Allows the transfer of firearms without a background check to individuals who participate in the TSA Pre-Check program of the Department of Homeland Security.
Dean Amendment (10 minutes of debate)

Clarifies that someone who is at risk of suicide may temporarily transfer a gun to someone else under the bill’s exemption from the background check requirement in instances of imminent threats of death or great bodily harm.
Horn Amendment (10 minutes of debate)

Clarifies that the “grave bodily harm” exemption from the background check requirement includes the harm of domestic violence, dating partner violence, sexual assault, stalking, and domestic abuse.
Van Drew Amendment (10 minutes of debate)

Clarifies that the exemption for gifts and loans of firearms between parents and children applies to step-parents and step-children.
